Dynamvs Inc. and its affiliates ("Dynamvs", "we", "us" or "our") respect your privacy and are committed to protecting your Personal Information by complying with this policy. We provide a property management software platform (the "Service") designed to help property owners, managers, and Residents streamline their operations.

When we talk about "Personal Information", we mean any information about an identifiable individual, which includes information that can be used on its own or with other information to identify, contact, or locate a single person. Personal Information does include business contact information, including your name, title, or business contact information.

This policy explains how we collect, use, share, and protect your Personal Information when you use our Service. It also describes your rights and choices regarding your information. This policy is designed to comply with applicable privacy laws in the United States and Canada, including the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada and various U.S. state privacy laws.

This policy applies to information we collect, use, or disclose about you:

  • on or through the Services;
  • in email, text, and other electronic messages between you and us, or that you transmit through the Services;
  • through our offline interactions; and
  • when you interact with our advertising and application on third-party websites and services if those applications or advertisements include links to this policy.

The Services may include links to third-party websites, plug-ins, services, social networks, or applications. Clicking on those links or enabling those connections may allow the third party to collect or share data about you. If you follow a link to a third-party website or engage a third-party plugin, please note that these third parties have their own privacy policies and we do not accept any responsibility or liability for these policies. We do not control these third-party websites, and we encourage you to read the privacy policy of every website you visit.

This policy does not apply to information that you provide to or is collected by any third party, through any application or content (including advertising) that may link to or be accessible from or through the Services.

Capitalized terms not defined in this policy have the meanings provided in the Services' Terms and Conditions.

By using our Service, you agree to the collection and use of information in accordance with this policy.

2. Information We Collect

We collect and use several types of information from and about you, including:

Personal information, that we can reasonably use to directly and indirectly identify you, such as your name, mailing address, e-mail address, telephone number, Internet protocol (IP) address used to connect your computer to the Internet, user name or other similar identifier, billing and account information, your government-issued ID, professional or landlord references, profile photo or avatar, geographic location, salary and employment information, and any other identifier we may use to contact you.

Non-personal information, that does not directly or indirectly reveal your identity or directly relate to an identifiable individual, such as demographic information, or statistical or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from Personal Information. For example, we may aggregate Personal Information to calculate the percentage of users accessing a specific feature on the Services.

Technical information, including your login information, browser type and version, time zone settings, browser plug-in types and versions, operating system and platform, or information about your internet connection, the equipment you use to access our Services, and usage details.

Details about your interactions with the Services, including full Uniform Resource Locators (URLs), clickstream to, through, and from the Services (including date and time), products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, or any phone number used to call our customer service number.

3. How We Use Your Information

We use your Personal Information for the following purposes:

To Provide and Maintain Our Service: To create and manage accounts, process rent payments and subscription fees, facilitate communication between Residents and managers, and manage maintenance requests.

To Facilitate Resident Screening: To process rental applications and facilitate credit and background checks through our integrated third-party screening providers, as directed by the Property Manager.

To Communicate With You: To send you service-related notifications, security alerts, support messages, and administrative information.

For Customer Support: To respond to your questions, comments, and requests.

To Improve Our Service: To analyze usage trends and user feedback to understand how we can enhance the user experience and develop new features.

For Security and Compliance: To prevent fraud, enforce our Terms of Service, and comply with our legal obligations.

For Marketing: To send you promotional communications about new features or services, from which you may opt-out at any time.

4. How We Share Your Information

We do not sell your Personal Information in the traditional sense. We may share your information with the following parties under specific circumstances:

Between Users: We share information between Residents and their respective Property Managers as necessary to facilitate the core functions of the Service (e.g., sharing a maintenance request from a Resident with their manager).

With Third-Party Service Providers: We engage trusted third-party companies to perform services on our behalf. These may include:

  • Payment Processors (e.g., Stripe) to securely handle financial transactions.
  • Cloud Hosting Providers (e.g., Amazon Web Services) to store our data.
  • Resident Screening Services (e.g., Equifax) to conduct background and credit checks at the direction of a Property Manager.
  • Communication Tools (e.g., Twilio, SendGrid) to send emails and SMS messages.

These providers are contractually obligated to safeguard your information and are prohibited from using it for any other purpose.

For Legal Reasons: We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court or government agency).

Business Transfers: In the event of a merger, acquisition, or sale of assets, your Personal Information may be transferred. We will provide notice before your information is transferred and becomes subject to a different privacy policy.

5. Data Security

We implement commercially reasonable technical, administrative, and organizational measures to protect your Personal Information from unauthorized access, use, or disclosure. These measures include data encryption in transit and at rest, access controls, and regular security assessments. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee its absolute security.

6. Data Retention

We will retain your Personal Information only for as long as is necessary for the purposes set out in this Privacy Policy, including for the purposes of satisfying any legal, accounting, or reporting requirements.

7. International Data Transfers

Your information, including Personal Information, may be transferred to—and maintained on—computers located outside of your state, province, or country where the data protection laws may differ. If you are a resident of Canada, your information may be processed and stored in the United States and may be accessible to U.S. law enforcement and national security authorities.

8. Your Rights and Choices

You have certain rights regarding your Personal Information, subject to local law.

a) For All Users:

Access and Correction: You may review and update your account information by logging into your account settings.

Marketing Opt-Out: You can unsubscribe from our promotional emails by following the instructions in those emails.

b) For Residents of Canada (PIPEDA):

Right to Access: You have the right to request access to the Personal Information we hold about you.

Right to Correction: You have the right to request correction of inaccurate or incomplete information.

Right to Withdraw Consent: You may withdraw your consent to our collection, use, and disclosure of your information at any time, subject to legal or contractual restrictions.

c) For Residents of U.S. States with Applicable Privacy Laws (e.g., California's CCPA/CPRA):

Right to Know: You have the right to request information about the categories and specific pieces of Personal Information we have collected about you, as well as the sources, purposes, and third parties with whom it is shared.

Right to Delete: You have the right to request the deletion of your Personal Information, subject to certain exceptions.

Right to Correct: You have the right to request correction of inaccurate Personal Information.

Right to Opt-Out of Sale/Sharing: We do not "sell" your data in the traditional sense. However, under some laws, sharing data for analytics or cross-context behavioral advertising may be considered a "sale" or "sharing." You have the right to opt-out of such activities.

No Retaliation: We will not discriminate against you for exercising any of your privacy rights.

9. Children's Privacy

Our Service is not intended for use by anyone under the age of 18. We do not knowingly collect personally identifiable information from children. If we become aware that we have collected Personal Information from a child without verification of parental consent, we take steps to remove that information from our servers.

10. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the “Effective Date” at the top. We may also notify you via email or through a prominent notice on our Service.
